机构在8月份宣布，除烟草和薄荷醇以外的口味产品的PMTA不包含足够的特定产品科学证据证明对成年吸烟者有足够的好处，能克服青少年构成的风险，就会被拒绝。 

许多获得 MDO 的公司还有其他产品，主要包括烟草和薄荷味的电子烟油，该机构仍在考虑使用 PMTA 进行市场授权，但收到 MDO 并不意味着公司将关闭。

PMTA 被拒绝的产品必须从市场上撤下，否则制造商和销售商可能会受到 FDA 的进一步执法。

美国食品和药物管理局昨天表示，没有申请未决的产品，包括例如那些有营销拒绝令的产品和没有提交申请的产品，是我们的最高执法优先事项。

然而，FDA 承认，实际上，我们无法对每一种非法销售的烟草产品采取执法行动，我们需要充分利用该机构的资源。

许多电子烟油制造商表示，他们将继续销售用合成尼古丁重新配制的调味产品，这是一个合法的灰色地带。

FDA 尚未尝试对合成尼古丁产品采取行动，在其目前的授权下可能无法采取行动。
